Colorado criminal law: ‘Odd behavior’ claims lead to arrest

Coaches and teachers in Colorado often spend a great deal of time with students. As a result, they develop special relationships with these students — relationships that are not violations of any criminal law. Unfortunately, many outsiders may not fully understand these unique relationships and may misinterpret them. One teacher has recently been arrested on allegations that he sexually assaulted a student.

Many details of the case are unclear. The man who was arrested served as both a math teacher and a coach to the boys’ and girls’ soccer and basketball teams. Concerns were raised when what was described as “odd behavior” was observed and reported to school officials who then conducted an investigation. Following that, officials contacted the police department.

The man has since been charged with sexual assault on a child with a pattern of abuse and in a position of trust. He resigned his position following his arrest. Police are asking anyone with information to contact them.

Many of the details in the case are unclear, including what behavior was originally observed that sparked the initial investigation. Unfortunately, many people are primed to automatically accept guilt regardless of evidence when accusations involve a teacher and student. Because of this, those facing allegations of violations of certain criminal law in Colorado may feel they have an uphill battle. A criminal defense attorney can provide guidance for those in such a situation, helping defendants make informed decisions about the direction of their cases as well as ensuring lawful treatment throughout the proceedings.
