Text message prompts residence search that leads to drug charges

There are many aspects of arrests and search and seizure proceedings that are subject to challenge, and in many cases any irregularities documented could be enough to get a criminal case dismissed. A Colorado woman was recently arrested on drug charges at her Grand Junction home. Her legal counsel will likely scrutinize every step taken by the deputies who arrested her and later searched her house.

The Mesa County Sheriff's Office reports that deputies arrived at the residence of the 48-year-old woman, who has a pending drug distribution case against her. During the arrest, deputies allegedly found over $2,200 on the woman, and some of the deputies reportedly identified various indications of drug use. During the time, they claim to have noticed an incoming text message that urged the woman to put everything in the safe. They say created suspicion, and a search warrant was obtained.

Deputies claim to have discovered and seized multiple items throughout the residence that are typically used for drug distribution, along with methamphetamine, a handgun and ammunition in the safe. Along with drug possession with the intent to distribute, the court advised her that firearm possession by an offender, and having drugs near a firearm might be added to the charges. The judge issued a $50,000 cash-only bond.

Those who face drug charges in Colorado will likely benefit by retaining the services of an experienced criminal defense attorney from the outset. Not only can a lawyer protect the legal rights of the defendant, but he or she can be there every step of the way to identify suspect law enforcement procedures immediately. The attorney can address such issues in court while advocating for the client in pursuit of the best possible outcome.
